Your next on-site Bank Secrecy Act (BSA)
examination will not be like your last one. Earlier this summer the
regulatory agencies published the “Bank Secrecy Act Anti-Money
Laundering Examination Manual.” (the Manual) It reflects an
interagency effort to homogenize the BSA examination process for all
U.S. banks. Those procedures are currently in use and they will provide
the critical guidance for all BSA examinations conducted in the future.
At more than 300 pages, the Manual provides guidance in
many areas of BSA compliance and revises
the concepts and terminology which should be found in standard compliance
efforts. Some key concepts include:

the need for a
formal BSA/AML/OFAC risk assessment, |

an expectation that banks will
identify their high risk customers
based on individual analysis,
not just the type of business
they are in, |

how banks can expect their
on-site examination to be “scoped” before
examiners even arrive, and |

increased focus on supplementing
customer identification programs
with “customer due diligence” and “enhanced
customer due diligence.” |

Meet your Speaker
Ken Golliher is a principal
with Pegasus Educational Services,
LLC, a training firm headquartered
in Louisville, Kentucky. He is an experienced
banker with a unique ability to reduce
complex legal concepts to plain English.
He has explained the “why” and “how” of
regulations to thousands of financial
institution personnel and examiners.
Ken’s banking career began in
1972 and includes serving as a teller,
commercial operations manager and as
trust department legal counsel in a
state and a national bank. For ten
years he headed the education division
of a regional consulting firm for financial
institutions. He has served on the
faculty of the LSU Graduate School
of Banking, the OTS’ Level I
Compliance School and the FDIC’s
Advanced Consumer Protection School
for examiners. He has presented seminars
in more than 25 states and has served
as an instructor at compliance schools
sponsored by ten state bankers associations.
He is a member of the Society for Applied
Learning Technology. He is also a moderator
of the BSA and Florida forums at Bankersonline,
